These policies explain how PCP Innovation handles projects, payments, privacy, communication, and the use of our website and services.

01 — Terms of Service

Terms of Service

These Terms of Service govern the use of the PCP Innovation website and the professional services provided by PCP Innovation (“PCP Innovation,” “we,” “our,” or “us”).

By using this website, submitting an inquiry, accepting a proposal, paying an invoice, or engaging our services, you agree to these Terms of Service. If you do not agree, please do not use this website or engage our services.

Services

PCP Innovation may provide web design, website development, website redesign, landing page development, website maintenance, technical optimization, consultation, and related digital services.

The exact services, deliverables, timeline, payment schedule, and project requirements will be defined in a written proposal, estimate, statement of work, invoice, or service agreement. If a written agreement contains terms different from this page, the written agreement will control for that specific project.

Client Responsibilities

Clients are responsible for providing accurate information, timely feedback, written approvals, content, images, branding materials, credentials, and other project materials required to complete the work.

Clients confirm that they own, have permission to use, or have properly licensed all text, logos, images, videos, trademarks, product information, and other materials they provide to PCP Innovation.

PCP Innovation is not responsible for claims, losses, delays, or legal issues resulting from client-provided content, incorrect information, copyright infringement, trademark infringement, or materials supplied without the appropriate rights or permissions.

02 — Payment & Refund Policy

Payment, Deposit & Refund Policy

A project is not officially scheduled or started until the required initial payment has been received and cleared.

Initial Payment / Deposit

Unless otherwise stated in a written proposal or invoice, PCP Innovation requires a 50% initial payment before beginning design, development, planning, research, content preparation, technical setup, or any project-related work.

The initial payment reserves project time, covers onboarding, planning, early-stage work, and protects the availability of the project schedule. For this reason, initial payments are generally non-refundable once work has started, except where required by applicable law or specifically agreed in writing by PCP Innovation.

Remaining Balance

The remaining project balance is due according to the approved proposal, invoice, or payment schedule. Unless a different written agreement applies, the final balance must be paid before website launch, transfer of final files, transfer of ownership, or release of administrative access.

Late Payments

Invoices are due by the date shown on the invoice. If payment is not received by the due date, PCP Innovation may pause work, delay launch, withhold deliverables, suspend support, or reschedule the project until the account is current.

Any timeline provided by PCP Innovation may be adjusted when client approvals, payments, materials, or communications are delayed.

Refunds

Because digital design and development services involve time, specialized labor, planning, and custom work, completed work, approved milestones, consultation time, setup work, and work already performed are not refundable.

Refund requests, if any, will be evaluated individually based on the written agreement, completed work, project status, and applicable law. PCP Innovation is not required to issue refunds for changes of mind, delays caused by the client, lack of communication, unused services, third-party platform issues, or client-requested project cancellation after work has begun.

Chargebacks and Payment Disputes

Before initiating a chargeback, payment dispute, or reversal, clients agree to contact PCP Innovation at info@pcpinnovation.net and allow a reasonable opportunity to resolve the concern.

Documentation of proposals, approvals, invoices, communications, delivered files, project records, development activity, and completed work may be used to respond to payment disputes or chargebacks.

03 — Project Scope & Delivery

Project Scope, Revisions & Delivery

Scope of Work

Services are limited to the scope described in the approved proposal, estimate, invoice, or statement of work. Requests that are outside the original scope may require a revised timeline, additional invoice, or separate agreement.

Revisions

Revision rounds, if included, will be described in the approved proposal. Revisions are intended for reasonable adjustments to the approved direction and do not include complete redesigns, major strategy changes, new pages, new functionality, new integrations, or substantial changes requested after approval.

Client Delays

Project timelines depend on timely responses, approvals, content, access credentials, and feedback from the client. If a project becomes inactive because the client does not respond or provide required materials for 14 consecutive days, PCP Innovation may pause the project.

Projects inactive for 30 consecutive days may be subject to rescheduling fees, reactivation fees, revised timelines, or closure, depending on the current project schedule and work completed.

Launch and Final Approval

Clients are responsible for reviewing the website before launch, including text, images, contact details, links, product information, legal content, pricing, and overall functionality.

Once the client provides launch approval, PCP Innovation may publish the website. PCP Innovation is not responsible for errors approved by the client, post-launch changes, content inaccuracies, business decisions, or issues caused by changes made by the client or third parties.

Post-Launch Correction Period

Unless otherwise stated in writing, PCP Innovation may provide a 14-calendar-day post-launch correction period for reproducible technical errors directly related to the original approved scope.

This does not include new features, additional pages, content changes, design changes, third-party updates, plugin conflicts, browser changes, hosting issues, client edits, or requests outside the original scope.

Ownership

Upon full payment of all invoices, clients receive ownership rights to the final approved website deliverables specifically created for their project, excluding third-party software, fonts, plugins, stock assets, frameworks, templates, tools, code libraries, and licensed materials.

PCP Innovation retains ownership of its pre-existing materials, methods, workflows, reusable code, design systems, templates, internal tools, and intellectual property. PCP Innovation may display completed work in its portfolio, website, social media, and promotional materials unless otherwise agreed in writing.

04 — Privacy Policy

Our website may contain links to third-party websites, including client projects, social media platforms, maps, payment processors, hosting providers, and other external services. PCP Innovation is not responsible for the privacy practices, content, security, or policies of third-party websites.

Cookies and Analytics

Our website may use essential technical cookies or third-party tools that help us understand website performance and improve user experience. You can generally control or disable cookies through your browser settings.

If PCP Innovation installs analytics, advertising tools, chat tools, payment platforms, booking tools, or other third-party technologies, those services may have their own privacy policies and data practices.

05 — Disclaimers & Liability

Disclaimers, Third Parties & Limitation of Liability

No Guarantee of Business Results

PCP Innovation designs and develops websites intended to support a professional online presence, user experience, and business goals. However, we do not guarantee specific sales, revenue, rankings, traffic levels, leads, conversion rates, search engine placement, advertising results, or other business outcomes.

Search Engines and SEO

Search engine algorithms, indexing decisions, rankings, competitors, advertising platforms, and online visibility are controlled by third parties and may change at any time. PCP Innovation does not guarantee rankings, indexing, traffic, or specific SEO results.

Third-Party Services

Websites may rely on third-party services such as hosting providers, domain registrars, payment gateways, plugins, themes, email services, e-commerce platforms, APIs, fonts, maps, analytics providers, booking systems, and social media platforms.

PCP Innovation is not responsible for outages, policy changes, service interruptions, security incidents, pricing changes, account suspensions, compatibility issues, updates, data loss, or failures caused by third-party services.

Website Maintenance

Unless an active maintenance agreement is in place, ongoing updates, software compatibility, plugin updates, backups, security monitoring, content changes, and technical support after launch are not included.

Limitation of Liability

To the maximum extent permitted by applicable law, PCP Innovation will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, business interruption, or reputational harm arising from the use of our website or services.

To the maximum extent permitted by law, PCP Innovation’s total liability related to a specific project will not exceed the amount actually paid by the client to PCP Innovation for the specific service giving rise to the claim.

Indemnification

Clients agree to defend, indemnify, and hold harmless PCP Innovation from claims, damages, liabilities, losses, and expenses arising from client-provided content, client misuse of the website, violations of law, intellectual property infringement, inaccurate information, unauthorized access, or the client’s products, services, or business practices.

Governing Law

These policies and any dispute related to PCP Innovation services will be governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal proceeding, when permitted, will be handled in the appropriate courts located in Los Angeles County, California.
